DEPARTMENT INTERNET POLICY THE TERMS AND CONDITIONS ARE AGREED TO BY THE USER SIGNING AN APPLICATION FOR AN ACCOUNT 1. Responsibilities of User 1.1 The User must comply with all reasonable directions and instructions of the department in relation to the User's use of computing resources. 1.2 The User must ensure that all software used on User equipment is properly licensed. 1.3 The User must provide the department with User contact information including address and telephone number and promptly notify the department of any change in that contact information. 1.4 The User acknowledges and accepts that the User is responsible for the content of any data or information which the User may send or receive or store while using the computing resources. 1.5 The User must take every reasonable precaution to ensure that no person is able to make unauthorised use of or gain unauthorised access to the computing resources. 1.6 The User must not use, or suffer or permit another to use the computing resources provided by UQ in, or in relation to, the commission of an offence. 2. Ownership and Confidentiality of Data 2.1 UQ must take all reasonable steps to ensure that access to the User's transmitted, received or stored data is restricted to those UQ personnel who are required to have access to the same in order to enable UQ to comply with its obligations under this agreement or under law. 2.2 UQ must keep the User's transmitted or received data confidential but is not to retain as confidential any data if: a) the data is, or becomes part of the public domain otherwise than by breach of this agreement by UQ; or b) the data is required to be disclosed by the operation of any laws; or c) the User has given prior written approval to the disclosure of the data; or d) it is required by the Police or other law-enforcement agency to assist in the investigation of an offence. 2.3 All data stored on devices owned by UQ may be deemed to form part of The University of Queensland's official records and may be archived for permanent storage by The University of Queensland. 2.4 Any data stored on UQ devices and published or distributed to other network users by means such as Worldwide Web publishing or electronic mail that is deemed by UQ to be inconsistent with or inimical to the aims of UQ as an academic institution or any data that are reasonably believed by UQ to be stored in breach of any law, including copyright, may, at the sole discretion of UQ, be removed from that device without notice. 3. Indemnity and Liability 3.1 The User indemnifies and forever saves harmless UQ and each and every member of UQ's staff from and against any loss, cost, expense or liability arising from any claims, demands or proceedings by any person against UQ or any member of its staff whatsoever brought by any third party against UQ due to the use or attempted use of any facility or service covered by this agreement by the User or by any person authorised by the User. 3.2 Except as provided to the contrary in this Agreement and to the full extent permitted by law, all terms, conditions, warranties, undertakings, inducements or representations whether express, implied, statutory or otherwise relating in any way to the provision of the computing resources or other obligations under this agreement are excluded. 3.3 Without limiting the generality of the preceding clause and except as expressly provided in this agreement, UQ will not be under any liability to the User or to any third party in respect of any loss or damage (including consequential loss or damage), however caused, which may be suffered or incurred or which may arise directly or indirectly as a result of or in connection with the provision of the computing resources or UQ's failure to comply with UQ's obligations under this Agreement except as expressly provided in this Agreement. Plain English Terms and Conditions of Use and Liability Statement 1. This plain English statement of terms and conditions serves to explain and to augment the computing resources Full Terms and Conditions of Use and Liability Statement. Where there is a conflict between the Plain English Terms and Conditions of Use and the Full Conditions of use and Liability Statement, the computing resources Full Terms and Conditions of Use and Liability Statement will have precedence. 2. Access by users to computing and and networking facilities owned or operated by The University of Queensland imposes certain responsibilities and obligations and is granted subject to policies and statutes of the University and state and federal laws. 3. Staff and Students of The University of Queensland: This facility is provided to support the teaching, research and administration of the University. Use for other reasons such as, but not limited to, private, business, other profit, mischievous, or fraudulent purposes is not acceptable and may be dealt with under University Statutes or State or Commonwealth law as applicable. Use for other reasons, such as for private or business is available as an external client. 4. All users, including staff, visitors and students of UQ, may make appropriate use of the facilities which should always be legal and ethical, reflect academic honesty and community standards, and show restraint and consideration in the use of shared resources. Clients must demonstrate respect for intellectual property, ownership of data and information, system security mechanisms, and the individual's right to privacy and to freedom from intimidation, harassment and unwarranted annoyance. 5. UQ will not in any circumstance be liable for any incidental or consequential damages of any nature or kind whatsoever incurred in or as a result of your use of this service. 6. Compliance with the "appropriate use" conditions includes, but is not limited to: a) Do not share use of your account with anybody else. Do not divulge your password to anyone, and use a secure password. (See Prentice FactSheet 17: Choosing a Secure Password for ideas.) If you think your password has been compromised, or if you think your account has been used by somebody else, contact the department for assistance. b) Do not gain access to systems or services without authorisation from your account. Know in advance if a service offers open access or if you have explicit permission from the owners to use the service. It may be a criminal offence to obtain access to data without permission or to damage, delete, insert or alter data in any way without permission. c) Do not harass other users. d) Do not download copyright or illegal material. UQ does not accept responsibility for material fetched or held under your account. By choosing to fetch and/or store it, you accept responsibility for it. Use of any UQ service for fraudulent or criminal activity may be dealt with under University statutes or the appropriate State or Federal legislation. e) You accept responsibility to pay any costs or charges incurred by using your account. Such charges and costs of using services are detailed in relevant Prentice FactSheets and other publications. UQ reserves the right to change account eligibility at any time, as set out in the computing resources Full Terms and Conditions of Use and Liability Statement. 7. UQ strives to cooperate with other systems administrators, network providers, legal authorities of the State and Commonwealth, and the international community to provide a reliable and trustable service. Good systems administration includes regular backups of disk space and the monitoring of system logs reflecting all use of the systems. Whilst we respect your privacy and right to use this service as freely as possible, we reserve the right to monitor user activity and act as deemed appropriate. Such actions may include suspension of access privileges, removal of user data from UQ storage devices, archival of user data as part of the University record or giving access to user data to State or Commonwealth authorities for the purposes of their investigations. 8. Recovery of files or other material that you delete from your network accounts will be reasonably undertaken, but we attempt to maintain high reliability and availability of the systems and of the information stored but offer no assurances of availability of the computing resources.
